1. Who we are

Privacy Telephone is a trade name of Avanto BV, with registered office at Herentalsesteenweg 25/1, 2460 Kasterlee, Belgium, registered under company and VAT number BE 1000.464.334.

2. Scope

These terms apply to every order placed through privacytelephone.com. By ordering, you accept them. We sell to consumers and businesses within the European Union.

3. Offer and prices

All prices are in euros and include VAT. Shipping costs are shown separately before you confirm your order. We sell devices that we buy new ourselves on the ordinary market and on which we then install GrapheneOS. We are not an official Google distributor. Obvious errors in price or description do not bind us.

4. Orders

The agreement is concluded as soon as we confirm your order by email. We reserve the right to refuse an order, for example where abuse is suspected or where a device turns out to be unavailable.

5. Payment

Payment is made by Bancontact or iDEAL through our payment partner Stripe. We do not receive or store your card or account details. An order is only prepared after payment has been received.

6. Delivery

We ship within Belgium and the European Union. The usual lead time is three to seven working days after payment, because each device is prepared individually. If that period is exceeded, you may grant us a reasonable additional period; if we still fail to deliver, you may terminate the agreement free of charge. Risk passes to you as soon as you take receipt of the parcel.

7. Right of withdrawal

As a consumer you may withdraw from the agreement within fourteen calendar days of receipt, without giving a reason. Tell us unambiguously within that period, using the address shown on your order confirmation. Return the device within fourteen days after that, complete, with accessories and packaging. The direct cost of return is yours.

We refund within fourteen days of receiving your notice, using the same payment method. We may wait until we have the device back. If you have used the device beyond what is necessary to establish its nature and functioning, we may charge for the reduction in value.

8. Legal warranty

Every device carries the statutory two-year warranty for defects already present at delivery. Report a defect within two months of discovering it. We repair, replace or refund. Normal wear, damage from drops or moisture, and damage caused by software you install yourself are excluded.

9. Returns and repair

Report a return or repair to the address on your order confirmation, quoting your order number and a short description. We will send you a return address and instructions. Make your own backup first: during repair or replacement the device may be wiped completely. Pack the device securely; damage occurring in transit because of inadequate packaging is at your expense.

10. Software

GrapheneOS is free software developed by an independent project and distributed under its own licence terms. We install that software, we do not develop it. We give no warranty on the operation of individual third-party apps or services and are not liable for data loss. If you unlock the bootloader yourself or install a different build yourself, our responsibility for the software state of the device ends; your statutory warranty on the hardware remains.

11. Old devices

Electrical and electronic equipment does not belong in residual waste. If you buy a device from us, you may hand in or return an old device of the same type to us free of charge; we arrange for correct processing. You can also drop off your old device free of charge at a recycling centre or at a retailer with a collection point.

12. Liability

Our liability is limited to direct damage and to the amount of the order concerned. Nothing in these terms limits your mandatory rights as a consumer.

13. Personal data

How we handle your data is set out in our privacy policy.

14. Disputes

Belgian law applies to this agreement. If we cannot resolve a dispute together, you can turn to the European ODR platform at https://ec.europa.eu/consumers/odr or to the Belgian Consumer Ombudsman Service at https://consumentenombudsdienst.be. The courts of the judicial district of Antwerp, Turnhout division, have jurisdiction.

GrapheneOS is an independent open source project. We are not affiliated with, endorsed by or a partner of GrapheneOS or Google. Google and Pixel are trademarks of Google LLC.
